Supreme Court of Appeal to hear arguments on class action against bread cartel on November 06 - 07 2012

Issued by Black Sash, The Children's Resources Centre, COSATU (Western Cape) and the National Consumer Forum

Arguments are due to commence in Bloemfontein the Supreme Court of Appeal in the next phase of our efforts to get a 'class certification order' to represent bread consumers in the Western Cape in our lawsuit against Pioneer Foods, Tiger Consumer Brands and Premier Foods.

We are confident that the Supreme Court of Appeal will overrule the August 2011 decision by Acting Judge Francois Van Zyl in the Western Cape High Court to refuse us the class certificate we requested.

As far back as 2007, these companies were found guilty of price-fixing by the Competition Tribunal. It is on the basis of that finding that we now seek to represent bread consumers in order to get financial compensation for the damages suffered as a result of the bread cartels’ collusion.

The court hearing will start at 09h30 on November 07 2012, and the litigants will brief the media on the steps of the court at 13h30. Additional information on the case is available on the Black Sash website ( Court papers for this hearing will also be placed on the website as soon as they have been filed with the court. We will be tweeting updates from @black_sash on #BreadPriceFixing.
